General Conditions

These general conditions apply to every quotation, offer and agreement between Amsterdam Schilderwerken ("we", "us", "our") and our client ("you"). We keep them clear and fair on purpose: we believe in transparency, personal contact and standing behind our work.

Article 1 — Definitions

  • Contractor: Amsterdam Schilderwerken.
  • Client: the natural person or company that requests a quotation from or enters into an agreement with us.
  • Work: the painting and related services we agree to carry out, such as interior and exterior painting, preparation, finishing and cleaning.
  • Agreement: the accepted quotation and any related arrangements between us and the client.

Article 2 — Applicability

These conditions apply to all our quotations and agreements. We provide them together with our quotation, so you can read them before you accept. Deviations are only valid when we confirm them in writing.

Article 3 — Quotations

All our quotations are free of charge and without obligation. Unless stated otherwise, a quotation is valid for 30 days from its date. Prices are stated including or excluding VAT as indicated, at the applicable rate. Obvious mistakes or errors in a quotation do not bind us.

Article 4 — Formation of the agreement

The agreement is formed when you accept our quotation in writing (including by e-mail or WhatsApp), or when we start the work at your request. We will always confirm the main arrangements with you personally.

Article 5 — Execution of the work

We carry out the work to the best of our knowledge and ability, with professional craftsmanship and high-quality materials. We agree a planning with you in advance and inform you in good time if circumstances (for example weather conditions for exterior work) require us to adjust it. An agreed timeline is an estimate and never a strict deadline, unless explicitly agreed in writing.

Article 6 — Your cooperation

To let us work safely and efficiently, you ensure that:

  • the areas to be painted are reasonably accessible and cleared;
  • we have free use of electricity and water at the location;
  • you inform us in advance of any particularities, other trades on site, or hazards.

If work is delayed because these conditions are not met, any resulting extra costs may be charged.

Article 7 — Additional and reduced work

If, during the work, it appears that extra work is needed (for example hidden damage, rot or extra preparation), we discuss this with you first and only carry it out after your approval. Work that turns out to be unnecessary is deducted. We always aim to avoid surprises on the invoice.

Article 8 — Completion

When the work is finished we go through it together. We leave your space clean and tidy, as if it were our own. Minor points that do not prevent normal use do not stand in the way of completion; we will resolve them within a reasonable period.

Article 9 — Warranty

We stand behind our work and provide a workmanship warranty of up to 5 years on the painting we carry out, depending on the type of work and the paint system used, provided the work is used and maintained normally.

The warranty covers defects that are attributable to our workmanship, such as premature peeling, blistering or flaking. The warranty does not cover: normal wear, damage caused by third parties or by you, structural defects or moisture problems of the building, movement or settling of the surface, and surfaces we advised against painting. The separate product warranty of the paint manufacturer remains additional to this.

Article 10 — Liability

Our liability is limited to direct damage that is the result of an attributable shortcoming in the performance of the work, up to a maximum of the invoice amount of the relevant agreement, or the amount paid out by our liability insurer. We are not liable for indirect or consequential damage. This limitation does not apply in the case of intent or deliberate recklessness on our part.

Article 11 — Prices and payment

Payment is due within 14 days of the invoice date, unless agreed otherwise. For larger projects we may agree on payment in instalments (for example a part on completion of the preparation and the remainder on completion of the work). If payment is not made on time, statutory interest and reasonable collection costs may be charged. Goods and work remain our property until full payment has been received.

Article 12 — Complaints

Are you not satisfied, or do you notice a defect? Please contact us as soon as possible, and at the latest within 14 days of discovery. We take every complaint seriously and will always first look for a solution together with you. You can reach us directly by phone, WhatsApp or e-mail.

Article 13 — Cancellation

You may cancel a confirmed agreement. Costs we have already reasonably incurred (such as ordered materials and reserved working days) may be charged. Where a statutory right of withdrawal applies to consumers, that right is respected.

Article 14 — Privacy

We only use your details to carry out the agreement and to contact you. We do not share your details with third parties except where necessary to perform the work or required by law.

Article 15 — Applicable law and disputes

Dutch law applies to all our agreements. If we cannot resolve a dispute together, it will be submitted to the competent court in the Netherlands.
